Notice and Takedown Procedure

Notice: Appalachian State University Library makes digital versions of materials available; for example, when they are in the public domain, the copyrights were transferred to the Library, donors provided permission to make materials available online, or there are no known restrictions on use. Appalachian State University Library makes the effort to ensure that it has appropriate rights to provide access to content through Belk Library’s Digital Collections website and the university's institutional repository, OpenAIR. These materials are made available for educational and scholarly use.

If you are the author/creator of materials on the Appalachian State University Library’s Digital Collections website or Appalachian State University’s scholarly database and you believe your materials have been posted without your permission, please contact dsi@appstate.edu and include the following:

  • Your contact information (including email address and phone number),
  • Exact URL where you found the material,
  • Details that describe the material (title, collection name, number of items, etc.),
  • The reason why you believe that your rights have been violated, with any pertinent documentation,
  • A statement that you in good faith believe that use of the material in the manner complained of is not authorized, and
  • A statement that the information in your notification is accurate and that you are the author/creator or are authorized to act on behalf of the author/creator.

Upon receipt of a request, Appalachian State University Library will:

  • Promptly acknowledge the request via email or other means of communication if you do not have an email account; and
  • Assess the validity of the request based on the available information.

Upon request, the University may temporarily remove the material from public view while we thoroughly assess the concern and relevant information provided. Upon completion of the assessment, we will take appropriate action and communicate that action to you in writing.

Submitting Data to the Institutional Repository

Research Data Submissions

*Open AIR is an institutional repository with some data repository capabilities, such as sharing and presenting data.  Depositors of data to Open AIR will receive a preliminary file size quota.  Space for larger datasets will be accommodated on a case by case basis.  Because of the open and public-facing nature of Open AIR, private data should not be uploaded or deposited into the institutional repository.  For data storage purposes, Appalachian State University faculty may use UNC-Chapel Hill's Dataverse.  

Dataverse

Research data owned and produced by Appalachian faculty may be hosted on Appalachian State University's Dataverse, which is provided by UNC Chapel Hill's Odum Institute. Dataverse is an open source repository for preserving and archiving research data. Dataverse offers the following advantages:

  • no cost to ASU faculty
  • integration with OpenAIR (forthcoming)
  • automatic indexing of tabular data
  • automatic conversion of tabular data to multiple formats
  • redundant, geographically distributed back-ups
  • cross-searchability with thousands of other datasets
  • long term storage of data
  • ability to control the degree of access others have to your data
  • ability to update datasets and keep track of multiple versions

 

Data Submission Form

ASU faculty, students, and staff should self-deposit datasets in Dataverse. For assistance with data deposit, data preservation, data management, and data publication (as mandated by granting agencies), please contact dsi@appstate.edu for more information. Figshare US Copyright Dispute Policy

Figshare has adopted the following policy toward copyright infringement in the United States in accordance with the Digital Millennium Copyright Act or DMCA. The address of Figshare’s Designated Agent to Receive Notification of Claimed Infringement ("Designated Agent") is listed at the end of this Section. It is Figshare’s policy to (1) block access to or remove material that it believes in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members or users; and (2) remove and discontinue service to repeat offenders.

Procedure for Reporting Copyright Infringements:

If you believe that material or content residing on or accessible through the Services infringes a copyright, please send a notice of copyright infringement containing the following information to the Designated Agent listed below:

  • a physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed;
  • identification of works or materials being infringed;
  • identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that Figshare is capable of finding and verifying its existence;
  • contact information about the notifier including address, telephone number and, if available, email address;
  • a statement that the notifier has a good faith belief that the material identified in (3) is not authorized by the copyright owner, its agent, or the law; and
  • a statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner.

Once Proper Bona Fide Infringement Notification is Received by the Designated Agent it is Figshare’s policy:

  • to remove or disable access to the infringing material;
  • to notify the content provider, member or user, that it has removed or disabled access to the material; and
  • that repeat offenders will have the infringing material removed from the system and that Figshare will terminate such content provider’s, member’s or user’s access to the Service.

Procedure to Supply a Counter-Notice to the Designated Agent:

If the content provider, member or user believes that the material that was removed (or to which access was disabled) is not infringing, or the content provider, member or user believes that it has the right to post and use such material from the copyright owner, the copyright owner’s agent, or, pursuant to the law, the content provider, member, or user, must send a counter-notice containing the following information to the Designated Agent listed below:

  • a physical or electronic signature of the content provider, member or user; identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
  • a statement that the content provider, member or user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and
  • content provider’s, member’s or user’s name, address, telephone number, and, if available, email address, and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the content provider’s, member’s or user’s address is located, or, if the content provider’s, member’s or user’s address is located outside the United States, for any judicial district in which Figshare is located, and that such person or entity will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Designated Agent, Figshare may send a copy of the counter-notice to the original complaining party informing that person that Figshare may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the counter-notice, at Figshare’s discretion.
